THE MINORITY LEADER
Establishment
of office of
Minority
Leader.
124. There shall be an office of Minority Leader of Saint Vincent
and the Grenadines, and appointments thereto shall be made in
accordance with section 125 of this Constitution.
125 (1) Whenever there is occasion for the appointment of a
Minority Leader the President shall appoint as Minority Leader the
member of the National Assembly who appears to the President,
acting in his own deliberate judgment, most likely to command the
support of a majority of the Representatives and Senators who do not
support the Government:
Provided that a Senator may be appointed as Minority
Leader only if there is no Representative who is qualified under this
subsection to be so appointed and is willing to accept such
appointment.
(2) If occasion arises to appoint a Minority Leader
during the period between a dissolution of Parliament and the day on
which the ensuing general election is held, an appointment may be
made as if Parliament had not been dissolved.
(3)
(a) If there are two or more members of the
Assembly who do not support the Government
but none of them commands the support of
the other or others, the President may, acting
in his own deliberate judgment, appoint any
one of them as Minority Leader; and
(b) in the exercise of his judgment the President
shall be guided by the seniority of each based
on his length of service as a member of
Parliament whether under this Constitution or
the former Constitution, by the number of
votes cast in favour of each at the last general
election, or by both such seniority and such
number of votes.
